President's Fiasco

Alot of discussion is going in media and in different circles about the turmoil that is going on. I am not writing the stuff that you would have already known. I am not a constitutional expert, but i have two little observations in the regard with the illegal appointment of judges by the incompetent President. First is that Article 177(1) it is clearly written that the President should appoint chief justice of Pakistan or any each of other judges with the consultation of Chief Justice of Pakistan. Now this is clearly written and cannot be denied by anyone. But to their defense the government says that the law of seniority should be applied. Now if we read the article 177(2) clauses (a) and (b) (http://www.pakistani.org/pakistan/constitution/part7.ch2.html) with other conditions, it clearly states that the judge to be appointed should have been a judge for more than 5 years in the High Court. Now the question is that if the law of seniority should be applied than why there is no clause which says that the judge to be appointed should be the senior most(chief justice of respective High Court)? and if the law of seniority should be applied than why to consult Chief Justice of Pakistan? and if law of seniority is applied than why appointed judge should be the judge of High Court for minimum 5 years? there is no sense in the government claim of following law of seniority.
Now let me highlight some points. The so called President who is following the law of seniority has ignored the seniority rule not one time or two time but five times in the previous year. is it a coincidence? that he doesnt knew about his self made seniority rule back then? The five judges who were elevated without being senior most by the same ignorant President were Justice Muhammad Sair Ali, Justice Mahmood Akhtar Shahid Siddiqui, Justice S Khawaja, Justice Khilji Arif Hassan and Justice Rahmat Husain Jafferi. How a country will progress when a person holding the highest office of the country doesnt knows the constitution of a country? Shame for the country and for the people.
